Q. I currently hold 2 real estate notes on property I sold last year in Oregon. The owner would like to refinance right now, but I would get less than half of what the note is worth. I need to either sell the notes or take the loss from the homeowner.Would i get more with selling it right now.

A. I am confused as to why you "would get less than half of what the note is worth." If you have recorded lien on the property for, say, $100k, and the note balance is $99,500, then in order for someone to refinance that balance, they'd have to find a lender willing to lend them $99,500 to pay off the mortgage. The only way you take less is if you discount the note and are willing to take less to satisfy the debt. Why would you "take a loss from the homeowner"? Do you have some kind of staggered balloon payment built into the note where if they pay you off early the balance is less, but if they pay later, the balance is higher? If that is the case, then you can find a note buyer pretty easily by googling, or find a local real estate… [cont.]

Q. I have recently heard of a trend that's actually been going on since the 1900s, I think called owner-financing permissionary notes, and I am flabbergasted about it. The reason being that, since I like real estate and I'm planning to study Interior Designing at an Art Institute-as well as this slow road to depression in the economy-I can potentially be able to invest in a few properties, sell them to people who can't afford a full price with a promissionary note at very reasonable interest rates and fees (just late fee) to make it affordable and to have a monthly cash flow. A. There are many ways to accomplish this. You may go to your nearest book store and purchase books on "Note Buying or Purchase" and other books on "Mortgage Notes" you might find. Owner carrying mortgages have been around long long time. You can do this type of mortgage in flipping properties, simply by carrying the difference between sales price of a property and the appraised value of the property. You carry the difference. This takes a lot of knowledge about collections, foreclosures when you are not paid. Who does the collection for you? do you out source this or do you do the collection yourself? There is a midnight guru that sell a program on note buying, but you also need to know how to create notes. I don't think purchasing one… [cont.]

A. Never tried that particular product, but I've been involved with real estate investing for some time. I can tell you that the program, I am sure, made notes sound easy and lucrative. It's definitely not. You'll have a very difficult time finding sellers and buyers, despite what the program says. I suggest you find and join a local real estate investing club and talk to some of the veterans. I don't know where you are, but the one I belong to in Dallas is dfwrein.com Woof.

A. Get Rich Quick is a misnomer. Unless your rich uncle dies and leaves you a wad of cash. Go to a site like CreativeInvestor.com and search the opinions on these late night info guys. Great Site with lots of info for anyone that wants to get into Real Estate. You can get most of those 'programs' cheaper on Ebay from all of those 'im gonna get rich quick' people who ordered...read it...stuck it in the closet and are now broker and need some funds for gas money next month.

A. are you asking for definitions on these words only or a real estate dictionary? a note is an agreement to make payments. It is like an IOU, but with lots of fancy terms. For example if I buy your house and you agree to let me owe you $10,000 of your equity paid for 5 years of interest only payments of $100 and then a baloon payment of $10,000 at the end. That would be an interest only note with a baloon payment. Real estate note means you are financing the purchase of real estate by promising to pay. A mortgage is something you give back to the note holder. It means you are putting up the property you bought as collateral for the note. If you don't pay then they can foreclose. It is a special word because kicking someone out of a house… [cont.]
